1. Important Legal Notice
1.1. These Terms and Conditions and Consent Agreement (“Terms”) govern your access to and use of the websites, landing pages, forms, guides, checklists, consultations, and other content or services offered by Kirsi-Marja Hardy (the “Provider”).
Kirsi-Marja Hardy offers insurance-related services in her individual capacity as a licensed insurance producer, not through Takara United LLC.
She provides information about Lincoln Heritage Funeral Advantage, a life insurance policy underwritten by Lincoln Heritage Life Insurance Company. Descriptions such as “final expense insurance and legacy planning” describe her services and do not identify a separately licensed agency or an approved trade name. Neither the website nor the offering is affiliated with or endorsed by any government agency. Insurance solicitation and related activity are undertaken only where she is properly licensed and authorized.
1.2. By accessing or using an offering governed by these Terms, submitting a form that presents these Terms, or otherwise affirmatively accepting them, you agree to be bound by them. If you do not agree, you must discontinue use of the applicable offering.
1.3. Section 24 provides for binding individual arbitration of certain disputes, a waiver of jury trial, and a class action waiver. These provisions affect your legal rights.
1.4. These Terms do not constitute an insurance policy. An insurer’s application, disclosures, and issued policy govern insurance coverage and the rights and obligations of the insurer and policyholder. Nothing in these Terms limits a right that cannot lawfully be waived.
2. Parties and Definitions
2.1. “You” and “your” mean the individual accessing Provider’s content, attending a session, requesting information, or using a service.
2.2. “Content” means Provider’s educational and promotional materials in any format, including guides, reports, checklists, worksheets, videos, webinar materials, presentations, frameworks, forms, and downloadable documents.
2.3. “Services” means Provider’s provision of information, responses to inquiries, consultations, and life insurance related activities undertaken through an appropriately licensed and authorized insurance producer.
2.4. “Insurer” means the insurance company underwriting or issuing the policy. Lincoln Heritage Life Insurance Company underwrites Funeral Advantage. The Provider is an individual producer and is not the insurer.
3. Eligibility and Information You Provide
3.1. You must be at least 18 years old to submit an inquiry or use an interactive Provider service. You represent that information you provide is accurate to the best of your knowledge and that you are authorized to provide any telephone number, email address, or other personal information submitted.
3.2. You are responsible for correcting material errors in information you provide. You must not submit another person’s medical, financial, insurance, or other sensitive information without appropriate authority.
3.3. Submission of a form does not obligate Provider to offer a consultation, submit an insurance application, or provide a particular product.
4. Scope of Services
4.1. The Provider is an individual licensed insurance producer who offers free educational resources and information relating to insurance services. Its lead generation and educational activities may include free guides, webinars, checklists, consultations, landing pages, online forms, advertisements, and public information sessions.
4.2. The Provider may discuss final expenses, family planning considerations, existing coverage, and available life insurance products. Any insurance solicitation, recommendation, or application assistance will be undertaken only where the individual producer is appropriately licensed and authorized.
4.3. Products and services may vary by state, insurer appointment, underwriting rules, and individual eligibility. The Provider may receive compensation in connection with an insurance sale. Receipt of free information does not obligate you to apply for or purchase insurance.
4.4. Provider may modify or discontinue an educational offering, subject to obligations arising under an existing written agreement and applicable law.
5. Educational Purpose Only
5.1. Content and public information sessions are provided for general educational purposes. They may simplify complex subjects, omit circumstances relevant to you, or become outdated.
5.2. A guide, checklist, assessment, estimate, example, or discussion of funeral expenses does not establish the amount of insurance you need, the cost of a future funeral, or the suitability of a particular product for you.
5.3. You should review your own circumstances, existing coverage, beneficiaries, financial obligations, and the applicable insurer’s current disclosures and policy provisions before making an insurance decision. Do not treat general Content as an individualized determination.
6. No Legal, Tax, Investment, or Fiduciary Advice
6.1. Provider does not provide legal, tax, accounting, investment, or fiduciary advice through its Content or Services. References to wills, trusts, powers of attorney, beneficiaries, taxes, or other legal or financial subjects are general information only.
6.2. Accessing Content, attending a session, or speaking with Provider does not create an attorney–client, accountant–client, investment adviser–client, or fiduciary relationship. You should consult an appropriately qualified professional for advice in those fields.
6.3. This Section does not diminish any duty applicable law imposes on Provider or an individual insurance producer in connection with an insurance transaction.
7. Insurance Applications, Policies, and Coverage
7.1. Descriptions of insurance products are summaries. Premiums, eligibility, benefits, waiting periods, graded or modified benefits, exclusions, riders, and other provisions depend on the product and insurer. The insurer’s approved forms and issued policy govern coverage.
7.2. Requesting information, receiving a quote, attending a consultation, or submitting an application does not create insurance coverage. Coverage begins only in accordance with the applicable insurer’s written terms and after satisfaction of any required conditions.
7.3. The insurer determines underwriting, policy issuance, administration, and claims under its policy. Provider cannot guarantee acceptance, a premium, an effective date, a benefit payment, or the outcome or timing of a claim.
7.4. You must answer application questions truthfully and completely and review an application before signing it. Material omissions or misstatements may affect issuance or benefits under applicable law and policy terms.
7.5. Do not cancel existing insurance solely because you received Provider Content or submitted a new application. Confirm the status and terms of any replacement coverage first.
8. No Guarantees or Income Claims
8.1. Provider does not guarantee financial savings, future funeral costs, family outcomes, insurance eligibility, policy approval, claim payment, income, business success, or any other financial result.
8.2. Examples, testimonials, illustrations, and estimates describe hypothetical or individual circumstances. They do not represent that you will experience the same outcome.
9. Lead Magnets and Free Content Disclaimer
9.1. Free guides, webinars, checklists, assessments, reports, and similar materials are educational and promotional. They do not replace an insurance contract, an individualized review of your circumstances, or advice from a professional qualified in another relevant field.
9.2. Provider may request contact information to deliver a resource or respond to an inquiry. Providing that information does not, by itself, constitute consent to receive promotional automated calls or text messages; any required consent is obtained through a separate, affirmative, unselected choice.
9.3. Provider may correct, revise, or withdraw free Content. You are responsible for confirming material information before relying on it for an insurance or financial decision.
10. Payment Terms
10.1. Provider’s informational products described in these Terms are offered without charge unless a particular offering expressly states otherwise before you obtain it. If the Provider offers a paid product or service, the price, payment schedule, and material purchase terms will be disclosed before payment. You authorize a charge only when you affirmatively complete the applicable purchase process.
10.2. Insurance premiums, if any, are governed by the insurer’s application, payment authorization, policy, and billing terms. Unless expressly disclosed otherwise, an insurance premium is not a fee for Provider’s educational Content.
10.3. Nothing in these Terms alters an insurer’s rules concerning premium payments, grace periods, cancellation, or lapse.
11. Refund Policy
11.1. Purchases of Provider’s paid digital products or services, if offered, are nonrefundable once access or delivery has been provided, unless a different refund policy was expressly disclosed before purchase or applicable law requires a refund.
11.2. This Section does not govern cancellation or refund rights associated with an insurance policy. Those rights are determined by the policy, insurer disclosures, and applicable law, including any applicable examination period.
12. Communications and SMS Consent
12.1. General Communications
When you provide contact information and request a guide, insurance quote, consultation, or other service, Kirsi-Marja Hardy may respond to your specific request as permitted by law. Providing contact information or accepting these Terms does not itself authorize marketing text messages, automated calls, or prerecorded calls. Consent, where required, is collected separately.
12.2. Appointment and Service Text Messages
If you affirmatively and separately opt in to receive appointment and service SMS communications, you may receive appointment confirmations, appointment reminders, scheduling updates, customer service responses, and communications relating to your specific inquiries.
12.3. Marketing and Promotional Text Messages
If you affirmatively and separately opt in to marketing SMS communications, you may receive educational information, invitations to review your insurance coverage, final expense insurance information, and promotional messages about the Provider’s services.
Consent to marketing text messages is optional and is not a condition of purchasing any goods or services.
12.4. Message Frequency and Charges
Message frequency varies based on your appointments, requests, and selected communication preferences.
Message and data rates may apply.
12.5. Opting Out and Requesting Help
You may unsubscribe from text messages at any time by replying STOP.
For assistance, reply HELP or contact the Provider at:
Phone: (318) 540-7509
Email: [email protected]
Carriers are not liable for delayed or undelivered messages.
12.6. Separate Consent
Appointment/service messaging consent and marketing messaging consent are requested separately where applicable.
Consent must be affirmative. Merely visiting the website, submitting a form, or accepting these Terms does not automatically establish permission to receive marketing text messages.
Any additional consent required for automated calls, prerecorded messages, or other regulated
communications will be obtained as applicable.
12.7. Privacy
The Provider’s collection and handling of personal information, including SMS consent information, are explained in the Privacy Policy:
https://book.planningisanactoflove.com/privacy-policy-page
13. Opt-Out Instructions and Revocation
13.1. You may opt out of promotional text messages by replying STOP or by communicating your request through another reasonable method. You may request that promotional calls stop by telling the caller or contacting Provider at [email protected] or 318-540-7509.
13.2. You may opt out of commercial emails through the unsubscribe method provided in the email or by contacting Provider. Provider will process revocation and opt-out requests within the time required by applicable law.
13.3. An opt-out from promotional messages does not prevent communications that applicable law permits or requires in connection with an existing transaction or policy, subject to your applicable rights and preferences.
13.4. If you change or relinquish a telephone number, notify Provider so its records can be updated.
14. Assumption of Risk and Independent Decisions
14.1. You acknowledge that insurance and planning decisions involve uncertainty. Costs, circumstances, product availability, and individual needs may change.
14.2. To the extent permitted by law, you assume the risks of decisions you make based solely on general Content without reviewing relevant insurer documents or obtaining appropriate individualized advice.
14.3. You are responsible for your use of Content and for the consequences of altering or redistributing it without its material qualifications. Nothing in these Terms transfers to you a risk that applicable law prohibits Provider from transferring.
15. Intellectual Property Rights
15.1. Provider or its licensors retain all rights in the Content and Services, to the extent owned or licensed by the Provider, including rights in text, graphics, recordings, guides, worksheets, documents, training materials, processes, systems, and frameworks. Materials bearing the names “Planning Is an Act of Love™” or “C.A.L.M.™” are included to the extent Provider owns or is authorized to use them.
15.2. Provider grants you a limited, revocable, nonexclusive, nontransferable license to access and use Content for your personal, noncommercial purposes, subject to these Terms. No intellectual property right is sold, assigned, or otherwise transferred to you.
15.3. Except as permitted by applicable law or Provider’s prior written authorization, you may not reproduce, sell, license, publish, distribute, rebrand, or create a competing product from Provider Content. Insurer names, logos, policy forms, and other third party materials remain the property of their respective owners.
16. Acceptable Use of Materials
16.1. You must not use Provider offerings to violate law; impersonate another person; submit knowingly false information; interfere with digital security or operation; introduce malicious code; collect data without authorization; or infringe another person’s rights.
16.2. You must not remove material qualifications from Content or present educational material as a binding quote, issued policy, legal opinion, or guarantee.
16.3. Provider may restrict access for conduct that materially violates these Terms, subject to applicable law.
17. Privacy and Information Security
17.1. Provider’s collection, use, retention, and disclosure of personal information are also governed by the separately posted Privacy Policy and applicable law. You should review that policy before submitting personal information:
https://book.planningisanactoflove.com/privacy-policy-page
17.2. Do not submit diagnoses, detailed medical history, Social Security numbers, banking or payment-card information, or other sensitive data through general website forms, ordinary email, or SMS. If an application requires such information, use the insurer-approved process identified by the Provider. Website analytics and advertising tracking should not receive medical answers or sensitive insurance information through URLs, events, or custom parameters.
17.3. No internet transmission or storage system is perfectly secure. Provider will comply with applicable legal duties concerning personal information but cannot guarantee the security of systems or communications beyond its control.
18. Third Party Links and Services
18.1. Provider offerings may link to insurer websites, online forms, scheduling tools, video platforms, email services, or other third party resources. Those parties may impose separate terms and privacy practices.
18.2. Provider does not control or warrant the content, availability, or practices of unaffiliated third parties. A link alone does not constitute an endorsement. This Section does not diminish responsibilities imposed on Provider by applicable law for providers it selects or information it handles.
19. Disclaimer of Warranties
19.1. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY PROVIDES ITS GENERAL CONTENT, WEBSITE, AND FREE DIGITAL RESOURCES “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NONINTERFERENCE, AND NONINFRINGEMENT.
19.2. COMPANY DOES NOT WARRANT THAT ITS DIGITAL OFFERINGS WILL BE UNINTERRUPTED, ERROR FREE, OR FREE OF HARMFUL COMPONENTS. THIS SECTION DOES NOT ALTER RIGHTS THAT CANNOT LAWFULLY BE DISCLAIMED OR THE TERMS OF AN INSURANCE POLICY ISSUED BY AN INSURER.
20. Limitation of Liability
20.1. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF GENERAL CONTENT OR DIGITAL OFFERINGS, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.
20.2. TO THE FULLEST EXTENT PERMITTED BY LAW, COMPANY’S TOTAL LIABILITY ARISING FROM A PAID COMPANY DIGITAL PRODUCT OR SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID COMPANY FOR THAT PRODUCT OR SERVICE DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) $100. FOR A CLAIM ARISING SOLELY FROM A FREE DIGITAL RESOURCE, THE LIMIT IS $100.
20.3. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. THEY DO NOT LIMIT RIGHTS UNDER AN ISSUED INSURANCE POLICY AGAINST ITS INSURER OR EXCUSE COMPANY FROM COMPLIANCE WITH APPLICABLE INSURANCE, CONSUMER PROTECTION, PRIVACY, OR COMMUNICATIONS LAW.
21. Indemnification
21.1. To the extent permitted by law, you agree to defend and indemnify Provider and its owners, officers, employees, and agents against third party claims, losses, and reasonable expenses, including reasonable attorney fees, arising from your unlawful use of Provider offerings, infringement of third party rights, or material breach of these Terms.
21.2. This obligation does not apply to the extent a claim results from Provider’s own unlawful conduct, negligence, or breach of its legal duties. Provider will provide reasonably prompt notice of a covered claim and permit you to participate in its defense, subject to Provider’s right to control a defense involving its independent interests.
22. Regulatory Rights and Complaints
22.1. Nothing in these Terms prevents you from contacting an insurer, the Louisiana Department of Insurance, another insurance regulator, the Federal Communications Commission, the Federal Trade Commission, or another governmental authority; filing a regulatory complaint; or exercising a right that cannot lawfully be waived.
22.2. The dispute provisions below do not restrict a regulator’s lawful authority or any remedy that applicable law makes nonwaivable.
23. Informal Dispute Resolution
23.1. Before initiating arbitration, either party may send the other a written notice describing the dispute, the relevant facts, and the requested resolution. Notices to Provider must be sent to:
[email protected] with the subject line “Legal Dispute Notice.”
23.2. The parties will attempt in good faith to resolve the dispute for 30 days after receipt of notice. Either party may seek urgent relief permitted under Section 24 without waiting 30 days when necessary to preserve legal rights.
24. Arbitration Agreement; Jury Trial and Class Action Waivers
24.1. Agreement to Arbitrate. Except as stated in this Section, you and Provider agree that a dispute arising out of or relating to these Terms, the Content, or the Services will be resolved by binding arbitration administered by the American Arbitration Association under its applicable consumer rules, as modified only to the extent permitted by law. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement where applicable.
24.2. Exceptions. Either party may bring an eligible individual claim in small claims court. Either party may seek temporary or preliminary relief in a court of competent jurisdiction to protect intellectual property or preserve the status quo pending arbitration. Claims or remedies that applicable law prohibits from being subjected to predispute arbitration remain outside this agreement to the extent required by law.
24.3. Location, Procedure, and Fees. Arbitration hearings will take place in Shreveport, Louisiana, or remotely if permitted by the administrator and agreed to by the parties, unless applicable consumer rules or law require a different location or method. The arbitrator may award any individual remedy available under applicable law. The administrator’s applicable consumer rules govern fees, subject to any different allocation required by law.
24.4. Class Action Waiver. To the extent permitted by law, you and Provider agree to bring claims only in an individual capacity and not as a plaintiff, claimant, or class member in a class, collective,
consolidated, or representative proceeding. The arbitrator may not combine the claims of different persons without all affected parties’ consent, except where applicable law requires otherwise. If this waiver is found unenforceable for a particular claim, that claim will proceed in a court of competent jurisdiction to the extent required by law.
24.5. Waiver of Jury Trial. For disputes subject to binding arbitration, you and Provider knowingly waive the right to a court trial and jury trial. For any dispute properly heard in court, the parties waive jury trial only to the extent the waiver is valid under applicable law.
24.6. A court, rather than an arbitrator, will decide a challenge to the enforceability of the class action waiver. Other questions of arbitrability will be decided as applicable law requires.
25. Governing Law
25.1. Louisiana law governs these Terms and disputes concerning them, without regard to conflict of law rules, except where federal law governs or another jurisdiction’s nonwaivable consumer protection law applies.
25.2. For a dispute properly brought in court, the parties consent to the jurisdiction of courts in Caddo Parish, Louisiana, subject to applicable law concerning jurisdiction and venue.
26. Modification of Terms
26.1. Provider may revise these Terms by posting an updated version with a new “Last Updated” date. Material changes will apply prospectively, and Provider will provide additional notice where required by law.
26.2. A revision will not retroactively alter an accrued dispute, an issued insurance policy, a completed purchase, or an existing communications consent where new consent is required by law. Continued use after revised Terms become effective constitutes acceptance only to the extent permitted by law.
27. Severability and No Waiver
27.1. If a provision is held unenforceable, it will be limited to the minimum extent necessary, and the remaining provisions will remain effective, subject to Section 24.4 concerning the class action waiver.
27.2. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
28. Entire Agreement
28.1. These Terms, together with any applicable Privacy Policy, purchase terms, and separate written agreement governing a Provider service, constitute the agreement concerning the applicable Provider offering.
28.2. An insurance application, insurer disclosure, and issued policy are separate documents. These Terms do not amend an insurer’s policy or replace disclosures required by insurance law.
